OFFICIAL RULES
NO PURCHASE OR ANY PROMOTION OF SKILLET IS NECESSARY TO ENTER OR WIN. PURCHASE OR PROMOTION WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES (OTHER THAN RESIDENTS OF RHODE ISLAND, NEW YORK, FLORIDA AND PUERTO RICO) AT LEAST 18 YEARS OF AGE. THIS SWEEPSTAKES IS VOID WHERE PROHIBITED BY LAW.
1. Eligibility: The Skillet Sweepstakes (“Sweepstakes”) is open only to legal residents of the United States (other than residents of Rhode Island, New York, Florida and Puerto Rico) age 18 or older at time of entry. Employees, officers and directors of INO Records, LLC (“Sponsor”), and each of its respective parent companies, subsidiaries, corporate affiliates, distributors, advertising and promotion agencies, prize suppliers, and entities engaged in the design and implementation of the Sweepstakes and the immediate family members, IRS dependents, and members of the same household of such individuals are not eligible. "Immediate family" means parents, children, sisters, brothers and spouse and their respective spouses, regardless of where they reside. Void where prohibited.
2. How To Enter: You may enter the Sweepstakes on-line or mail-in. Any form of entry other than those described herein is void.
Online entry: Visit http://inorecords.com/skillet/streetteamcontest and follow the directions provided to complete and submit the online entry form for receipt by 11:59:59 PM EST on the date five (5) business days prior to the applicable Skillet concert date ("Concert") for which you are entering the Sweepstakes to be eligible ("Sweepstakes Deadline"). Limit of one entry per person or email address per day (12:00:01 AM EST – 11:59:59 PM EST). If there is a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person assigned to the email address by the organization responsible for assigning email addresses. Any attempt by any participant to obtain more than one (1) entry per day by using multiple/different email addresses, identities or any robotic, automatic and similar methods will void all that participant’s entries and that participant will be disqualified. In no way is it a requirement to nor will it increase a person's chances of winning to promote Skillet or any of their products, including without limitation, on any social networking pages or otherwise.
Mail-in entry: Hand-print your name, address, city, state, zip, phone number (including area code), email address, and date of birth on a 3” x 5” piece of paper and mail entry in a first class stamped envelope to: INO Records, LLC., Attn: Skillet Sweepstakes, 210 Jamestown Park, Ste. 100, Brentwood, TN 37027. You can enter as often as you like, but each mail-in entry must be mailed in a separate envelope postmarked no later than ten (10) days prior to the Concert for which you are entering the Sweepstakes and received by Sponsor at least five (5) business days prior to the Concert for which you are entering the Sweepstakes. No mechanical reproductions of mail-in entries will be accepted. All entries become the property of the Sponsor and will not be returned.
3. Drawing: A random drawing will be conducted by Sponsor and/or its representatives from among all eligible entries received between Tuesday, October 20, 2009 and the Sweepstakes Deadline. Odds of winning a prize depend on number of eligible entries received.
4. Notification: Prize winners will be notified by email (“Notification”) at least three (3) days prior to the date of the applicable Concert and will be required to complete and sign an Affidavit of Eligibility, a Liability Release and where permitted, a Publicity Release and return these documents within the time specified in the notification letter. Failure by Prize winner to return the completed documents by the time specified by Sponsor or the return of any prize winner to return and complete a prize notification as undeliverable will cause the prize to be forfeited. Sponsor is not responsible for any delay in prize delivery.
5. Prizes/Approximate Retails Values: One (1) winner for each Concert performed by Skillet during the time the Sweepstakes is in effect (October 20, 2009 – November 26, 2009) will win two (2) general admission tickets and a Meet & Greet pass for the Concert date for which the winner entered the Sweepstakes. Also, at your option, the chance to make an appearance on Skillet's video footage of the Concert which will be posted online with the winner's name listed. Approximate retail value is Seventy Dollars $70.00. All traveling and other expenses not specifically included in the prize as described in these Official Rules are hereby excluded, such as any food and travel.
6. Prize Restrictions: No cash or other prize substitution, in whole or in part except by Sponsor at its sole discretion due to prize unavailability for any reason and only then for prize of comparable or equal value. Alternate prizes or cash will not be offered in lieu of prizes described above. No prize may be transferred or exchanged. Limit one (1) prize per person/family/household/email address. Applicable taxes on prize and any expenses related to the acceptance and use of a prize and not specified in these Official Rules are the sole responsibility of the winner.
7. General Conditions: By participating, entrants agree: (a) to be bound by these Official Rules and the decisions of Sponsor shall be final and binding in all matters relating to the Sweepstakes; (b) to release, discharge and hold harmless Sponsor, and its respective affiliates, parent companies, subsidiaries, advertising and promotion agencies, and their respective shareholders, officers, directors, employees, representatives and agents (“Sweepstakes Entities”) from and against any and all liability, injuries, losses, damages, rights, claims and actions of any kind, including without limitation, personal injury and/or death or property damage, sustained in connection with his/her participation in this Sweepstakes, or from his/her receipt, possession, acceptance and/or use or misuse of any prize, or for any typographical or other error in the printing, offering or announcement of any prize; (c) that the foregoing Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to a prize; and (d) if a winner, by accepting prize, to the use of his/her name, photograph and/or likeness by Sponsor, or any party authorized by them for advertising, trade and promotional purposes in all media without review or additional compensation (except where prohibited by law) and, upon request, to provide such consent in writing. Sweepstakes Entities are not responsible for multiple entries entered by other than human means or other mechanical means, or for entries that are destroyed or are incomplete.
8. Liability Limitations: Any information collected from you in connection with the Sweepstakes will be delivered to Sponsor and may be used in accordance with the Sponsor's Privacy Policy and Terms of Use. IF YOU DO NOT AGREE TO THESE PRIVACY POLICIES AND TERMS OF USE WHICH ARE LOCATED AT INORECORDS.COM, DO NOT ENTER THE SWEEPSTAKES ONLINE, PROVIDE ANY PERSONAL INFORMATION ON THE WEB SITE OR OTHERWISE USE THE WEB SITE. Sponsor and/or its affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for: (a) printing, typographical or any other errors in any Sweepstakes-related materials and in the event of any inconsistency between Sweepstakes-related materials and these Official Rules, these Official Rules shall govern and control; (b) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error that may occur in the processing of entries; (c) failed, incomplete, garbled or delayed computer transmissions; (d) lost, late, misdirected, mutilated, incomplete, incorrect, illegible entries, returned entries or mail or postage due mail; or (e) any condition that may cause the Sweepstakes to be disrupted or corrupted. Sponsor reserves the right, at its sole discretion, to cancel, terminate or suspend the Sweepstakes or any portion thereof should viruses, bugs, technical difficulties, suspected or actual electronic tampering, or other causes corrupt the administration, security, integrity or proper play of the Sweepstakes. Sponsor reserves the right to void any entries determined by Sponsor in its sole discretion to have been submitted fraudulently or in contravention of the Official Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The Sweepstakes is subject to these Official Rules and all applicable federal, state and local laws. Winners are solely responsible for all taxes on all prizes. Sweepstakes shall be governed by laws of the State of Tennessee without regard to choice of law or conflict of law principles; and any dispute arising out of or connected in any way with the Sweepstakes shall be brought only in a federal or state court in the Davidson County, Tennessee and you waive all objections to such jurisdiction and venue.
